This Privacy Policy explains how we collect, use, store, and disclose personal information when you use our website and services, including when you sign up for a subscription or submit an enquiry through our contact form.

These Terms & Conditions ("Terms") govern your access to and use of the OrderForFood.com platform, including but not limited to, our website, point-of-sale, online ordering, and table booking services ("Services"), operated by DataGenius Technologies LLC ("we", "us", "our"). By signing up, you agree to these Terms.

1. Eligibility and accounts

•You must be at least 18 years old and authorised to act for the restaurant you register.
•You must provide accurate, current information during sign-up.
•You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Free trial

•New subscriptions include the clearly stipulated duration of the free trial period beginning on the date your email address is verified, and ending automatically on the last day of such stipulated duration.
•A payment method must be saved at sign-up. Your card is not charged until the trial period ends, unless you cancel earlier.
•You may cancel at any time before the end of the trial and you will not be charged.

3. Subscriptions, fees, and payment

•Subscriptions are billed in advance on a recurring basis to your saved payment method.
•Prices shown are in US dollars (USD) and no GST applicable due to payments made to a non-Australian and non-New Zealand entity.
•If a payment fails, we may suspend your access until payment is received.
•You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; no refunds are provided for partial periods unless required by law.

4. Acceptable use

You must not:

•Use the Services for any unlawful purpose or in breach of food safety, fair trading, or consumer laws applicable in Australia or New Zealand.
•Attempt to gain unauthorised access to our systems, other users' accounts, or data.
•Reverse engineer, resell, or misappropriate the Services except as expressly permitted.

5. Your content

You retain ownership of the content you upload to the Services (e.g., menus, photos, restaurant details). You grant us a limited licence to host, display, and process that content solely to operate the Services for you.

6. Intellectual property

The Services, software, branding, and design are owned by DataGenius Technologies LLC and protected by intellectual property laws. Nothing in these Terms transfers ownership of our intellectual property to you.

7. Availability and changes

We aim to provide the Services with reasonable availability, but we do not guarantee uninterrupted access. We may modify, update, or discontinue features of the Services. If a change materially reduces the core functionality you pay for, we will provide reasonable notice.

8. Consumer guarantees

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law, the Fair Trading Act 1986 (NZ), or the Consumer Guarantees Act 1993 (NZ), where such exclusion would be unlawful. If these laws apply, you may be entitled to a repair, replacement, refund, or compensation for reasonably foreseeable loss.

9. Liability

To the extent permitted by law (including the consumer law provisions above):

•Our liability arising from or related to the Services is limited, at our option, to resupplying the Services, paying the cost of resupply, or refunding the fees you paid for the relevant period.
•We are not liable for indirect, special, or consequential loss, including loss of profits, revenue, or business opportunities.

10. Termination

We may suspend or terminate your account if you breach these Terms, fail to pay fees, or where required by law. You may stop using the Services at any time; these Terms continue to apply to past use.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. If you are located in New Zealand, you also retain the benefit of mandatory protections under New Zealand law, and disputes may be resolved in the courts of that jurisdiction as required by applicable law.

12. Changes to these Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or through the Services. Continued use after changes take effect constitutes acceptance.
